The Beatles Brian Epstein Historic Twice-Signed "Beatles" Trade Mark Application Original File Documents.

A set of original file copy documents dating as early as 1963 submitted by Beatles manager Brian Epstein (Nems Enterprises, Ltd.) to the U.S. Department of Commerce Patent Office regarding the trademarking of the name "The Beatles'', including a letter that was mailed in 1971 from the Department of Commerce to Beatles attorney Walter Hofner regarding the possible cancellation of the trademark use due to its use not being filed with the department, and stating that if an affidavit or declaration had been filed, to disregard the notice.

This is an extraordinary set of documents, two of which are live-signed by Brian Epstein in blue ballpoint pen, both documents are dated February 7, 1964 and are addressed to the Commission of Patents, Trademark Registration, Washington 25, D.C. Both documents have the NEMS raised seal and both are stamped as being received by the U.S. Patent Office.

The dates of the two documents were only 2 days before the first live appearance by the Beatles on U.S. soil, when they appeared live on the Ed Sullivan Show on February 9. This archive features a total of 8 pages, measuring approximately 9 x 11 each (a few of the pages are slightly smaller), and are dated starting in 1963.

The final document which states it was mailed on July 9, 1971 is the letter from the U.S. Department of Commerce Patent Office written to Beatles attorney Walter Hofer regarding the possible cancellation of the trademark due to it not being filed as still being in use - with the caveat to ignore the notice if the affidavit or declaration of use had been filed. The notice is accompanied by its original envelope from the Department of Commerce with a stamp saying returned to sender as undeliverable to the attorney's address in New York City.

Dimensions: A total of 8 pages, slightly varying in size, the largest pages being 9 in x 11 in.

Condition: Overall very good vintage condition, with some light wear including a couple of small stains. Brian Epstein's signatures are strong and bold, in blue ballpoint pen.

Authentication: Authenticated by Beatles handwriting expert Frank Caiazzo. Upon request, Gotta Have Rock and Roll will help facilitate the winning bidder in obtaining a Letter of Authenticity from Mr. Caiazzo. Also comes with a Gotta Have Rock and Roll Certificate of Authenticity.
